1. Introduction

Welcome to Mega Fishing Thailand. These Terms & Conditions govern your use of our website megafishingthailand.com and the booking services we provide. By accessing or using our website or engaging our services, you agree to be bound by these terms.

If you do not agree with any part of these terms, you must not use our website or request our services.

Important: Mega Fishing Thailand is a booking agent and intermediary only. We do not own, operate, manage, or control the fishing trips, vessels, guides, equipment, or facilities. We introduce clients to independent third-party guides and operators ("Trip Providers") who are solely responsible for delivering the fishing experiences. We are not a party to the contract between you and any Trip Provider.

2. Our Services

Mega Fishing Thailand acts as an agent to connect you with independent Trip Providers offering guided fishing tours and experiences in Thailand, including destinations in Bangkok, Chiang Mai, Southern Thailand, and other locations. We assist with enquiries, facilitate introductions, and pass booking requests to the relevant Trip Provider(s).

Trip Providers are independent contractors operating their own businesses. They are responsible for all aspects of the trips they offer, including safety, equipment, staffing, pricing, and fulfilment. Any booking you make through our website constitutes a request, and a contract is formed directly between you and the Trip Provider, not with Mega Fishing Thailand.

3. Booking Process and Payments

  • When you submit an enquiry or booking request through our website (or by email, phone, or messaging), we will pass your details to the relevant Trip Provider(s) to respond to you directly.
  • Any pricing, payment terms, deposit requirements, and cancellation policies are set by the Trip Provider, not by Mega Fishing Thailand. We will pass those terms to you at the time of your enquiry but we do not control or guarantee them.
  • Payments for trips are typically made directly to the Trip Provider, not to Mega Fishing Thailand, unless otherwise agreed in writing in advance. Any payments made to us as agent will be passed on to the Trip Provider in accordance with our agency agreement with them.
  • Prices quoted by Trip Providers are subject to availability and may change without notice until your booking is confirmed in writing by the Trip Provider.
  • Any additional costs arising from changes you request after confirmation (e.g., changes to trip dates, locations, or group size) will be determined and charged by the Trip Provider.

4. Cancellation, Refunds, and Changes

  • Cancellation, refund, and change policies are determined solely by the Trip Provider with whom you book. Mega Fishing Thailand has no control over these policies and is not responsible for enforcing them.
  • Standard industry practice (subject to the Trip Provider's specific policy) is that cancellations made more than 30 days before the trip may be eligible for a partial or full refund, less any non-refundable deposit. Cancellations made within 30 days of the trip are typically non-refundable.
  • We will assist you with reasonable requests to contact a Trip Provider regarding cancellations or changes, but we cannot guarantee any particular outcome.
  • Trip Providers may cancel or reschedule trips due to adverse weather, safety concerns, insufficient bookings, or other circumstances beyond anyone's control. In such cases, the Trip Provider is responsible for offering rebooking or refund options in accordance with their own policy.

5. Limitations on Our Responsibility as Agents

Because we are agents only, our responsibility is limited to:

  • Passing your enquiry accurately to the appropriate Trip Provider(s).
  • Using reasonable efforts to assist you in communicating with the Trip Provider.

We are not responsible for:

  • The quality, safety, suitability, or legality of any Trip Provider's services, equipment, or facilities.
  • The acts or omissions of any Trip Provider, their staff, or agents.
  • Any injury, loss, damage, delay, or disappointment arising from or in connection with any trip or service provided by a Trip Provider.
  • Pricing, availability, or terms offered by Trip Providers, which may change without notice.

6. Your Responsibilities and Conduct

You are responsible for ensuring that you and all members of your party are physically capable of participating in the activities described and hold any necessary licences, permits, travel documentation, and insurance.

You agree to:

  • Follow all safety instructions given by your Trip Provider or their appointed guide.
  • Treat guides, crew, and any third-party service providers with respect.
  • Comply with all applicable local laws, fishing regulations, customs requirements, and environmental protections in Thailand.
  • Not engage in any illegal, abusive, or disruptive behaviour during any trip.

7. Health, Safety, and Insurance

Fishing and outdoor activities carry inherent risks. By engaging with a Trip Provider through our website, you acknowledge and accept these risks. We strongly recommend that you hold appropriate travel and activity insurance for the duration of your trip.

Safety measures, risk assessments, and emergency procedures are the responsibility of the Trip Provider, not Mega Fishing Thailand. We do not warrant or guarantee the safety of any trip or activity.

8. Limitation of Liability

To the fullest extent permitted by law, Mega Fishing Thailand shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or use, arising out of or related to your use of our website or our agency services.

Our total liability to you in respect of any claim arising out of or relating to these terms, our website, or our role as booking intermediary, shall not exceed the fees (if any) actually paid by you to Mega Fishing Thailand (not to the Trip Provider) in connection with the relevant enquiry or booking.

Nothing in these terms excludes or limits liability for death or personal injury caused by our proven negligence or fraud, or any other matter which cannot lawfully be excluded or limited.

Because we do not operate the trips, any claim relating to the conduct, safety, or quality of a trip should be directed to the relevant Trip Provider. We will provide reasonable assistance in facilitating contact but are not liable for the outcome.

9. Intellectual Property

All content on this website, including text, graphics, logos, images, and software, is the property of Mega Fishing Thailand or our licensors and is protected by intellectual property laws. You may not reproduce, distribute, modify, or exploit any content without our prior written permission.

10. Third-Party Links and Content

Our website may contain links to third-party websites or services, including Trip Providers' own websites and booking platforms. We are not responsible for the content, accuracy, availability, pricing, or practices of any third-party sites and do not endorse them. Accessing third-party links is at your own risk. Any contract you enter into with a third party is between you and that party.

11. Privacy and Data Protection

We collect and process personal data in accordance with our Privacy Policy. By using our website or services, you consent to such processing and warrant that all data provided by you is accurate. Please note our Privacy Policy explains how we share your data with Trip Providers as part of our intermediary role.

12. Governing Law

These terms shall be governed by and construed in accordance with the laws of Thailand. Any disputes arising out of or in connection with these terms, our website, or our role as booking intermediary shall be subject to the exclusive jurisdiction of the courts of Thailand.

Disputes relating to the actual trip experience, delivery of services by a Trip Provider, or any contract between you and a Trip Provider are governed by the terms of that contract and the Trip Provider's own policies. We are not a party to those contracts.

13. Changes to These Terms

We reserve the right to modify these terms at any time. Any changes will be posted on this page with an updated "Last updated" date. Your continued use of the website or our services after changes are posted constitutes your acceptance of the updated terms.
